Violating a protective order is a serious offense in the state of Utah. A protective order can only be granted where a Trier of fact finds that the petitioner is in an abusive environment, or is in imminent danger of being abused. Violation of Protective Orders Defined

Utah Code §76-5-108 finds a person in violation of a protective order when he or she intentionally or knowingly violates the specific conditions of said order.

Penalties for Violating Protective Orders

Violating a protective order carries penalties which increase with the severity and frequency of the violation. Penalties for the first offense are classified as a class A misdemeanor punishable by up to one year in jail and/or up to $2,500 in fines unless a greater penalty is specified by 77-36.

Repeat violations may be increased to a third-degree felony punishable by up to five years in prison and/or $5,000 in fines.

Modifications to the Sex Offender Registration: What You Need to Know

It is imperative that individuals, who have been convicted of a sex offense or another crime that requires him or her to register as a sex offender, properly register with the Utah Sex Offender Registry. Sex offenders also must be aware of any modifications to registration requirements as the requirements can change.  For example, a conviction for possession of child pornography requires lifetime registration rather than a ten-year registration as used to be the case.

The Utah Legislature introduced a series of amendments to the sex offender registration requirements. The Amendments were sponsored by Senator Curtis S. Bramble (R) and signed into law on March 28, 2017.

The bill does the following:

  • It specifies that a court may accept a guilty plea only if it is in conformity with the sex offender registration statute;
  • It requires that if a court modifies a conviction for a sex or kidnapping offense, that the court must notify the Department; and
  • It allows the Department of Corrections to intervene in matters that affect a person’s registration requirements.

Polygamy in Utah, Exploitation of Underage Girls or Religious Freedom

In late February of 2017, in Salt Lake City, UT, hundreds of individuals gathered to protest Utah Governor Gary Herbert’s signing of a new law that increases the penalties for polygamists convicted of committing fraud or abuse.

The new law is part of a larger ongoing conversation about the criminalization of polygamy in the State. In Utah, polygamy has always been illegal, but the practice has come under stricter scrutiny when the State prosecuted a number of individuals who were part of a fundamentalist Mormon sect that engages in polygamist marriages, many of which involve underage girls.

The issue involves religious freedom versus protecting underage girls from abusive practices.

In 2013, a federal court declared a large part of Utah’s ban on polygamy unconstitutional, specifically rejecting the ban on cohabitation between underage girls and older men who are not related. Utah lawmakers, however, are fighting to reinstate the ban on cohabitation, citing the need for the State to protect underage girls and to prevent welfare fraud.

You buy your dream house. You move in, unpack your boxes, and find the perfect places on the walls for your favorite photographs, line bookshelves with your childhood storybooks, and carefully place all your fine dinnerware received as wedding and anniversary gifts. You build a home for you and your family, creating memories of gratitude and cheer reflecting on how lucky you are. But then it starts to fall apart—and not because of problems with your child at school or an extramarital affair—no your family is happy, but your house literally starts to crack and crumble. This is what happened when a landslide in the city of North Salt Lake began to destroy a home. But the city refused to take responsibility, and now many of the neighborhood residents have hired a Salt Lake City real estate lawyer, claiming that they should have been informed of the potential danger of the area.

City Says It’s “Not Responsible”

But North Salt Lake City Manager Barry Edwards told the news media, “We’re not responsible because we were not up there doing anything.” Which may or may not fly, in terms of legal defensibleness, a real estate lawyer might say. Other attorneys, like the one already hired by one of the North Salt Lake residents, says that Edwards’ claim will absolutely not hold up. “The city should have issued a stop order last Fall when neighbors started to notice fissures and cracks,” many of which were reported to the city, but Edwards claims otherwise, saying, “Neither the city nor the developer seemed to be aware of the problem.”

Doing almost everything to avoid admitting legal liability, the city issued a statement that, to residents, sounded like “bunch of legal mumbo jumbo.” Yet the city did offer its sympathy and regret with an assurance that North Salt Lake will work hard to find out who is at fault for what happened. Meanwhile, residents see their home values plummeting and are anxious about more landslides and further destruction of property in the area. A Salt Lake City real estate lawyer hired by the residents have said that the sympathetic statement by the city may be politically correct, but it’s neither morally nor legally correct, and the residents plan to take the city to court.

The city hasn’t eliminated the possibility of paying out the residents for their homes, but again, making doubly sure to indicate that it would be for humanitarian reasons, careful to avoid admitting liability. Which is frustrating, disheartening and angering to area residents, who want answers and accountability. That may be something they never get, a Salt Lake City real estate lawyer could say, since liability can be a tricky issue. In the meantime, North Salt Lake City Manager Edwards reports having “a lot of people on the slide slope gathering data,” and hopes to find out more about the causes and further damage potential. Let’s hope they can do it responsibly, and in time for other residents.

While Utah code does not have a specific domestic assault and battery law, it contains laws addressing violent acts of abuse against individuals sharing a residence or related by marriage or by blood.

Domestic Assault and Battery Defined

Utah Code §77-36-1 states domestic violence includes any criminal offense involving violence, physical harm, or threat of violence or physical harm, or any attempt, conspiracy, or solicitation to commit a criminal offense involving violence or physical harm when committed by one cohabitant against another.

Domestic violence also includes attempts to commit any of the following by one cohabitant against another:

  • aggravated assault;
  • assault;
  • criminal homicide;
  • harassment;
  • electronic communication harassment;
  • kidnapping (including child and aggravated categories);
  • mayhem,
  • sexual offenses,
  • stalking,
  • unlawful detention of an adult or minor;
  • any offense against property in Title 76;
  • possession of a deadly weapon with intent to assault; discharge of a firearm from a vehicle, near a highway, or in the direction of a person, building, or vehicle;
  • disorderly conduct as a domestic violence offense; or
  • child abuse

Penalties for Domestic Assault and Battery Conviction

Domestic assault and battery are typically considered misdemeanors; however, penalties may become more severe if committed within five years of a previous qualifying domestic violence conviction.

In addition to jail time and possible fines, a domestic assault and battery conviction can result in protective orders barring access between the alleged actor and victim. It could also result in required electronic monitoring programs, court mandated counseling, or therapy.

Pleas in Abeyance

One option for those accused of domestic assault and battery to avoid an actual conviction is to make a plea in abeyance.

A plea in abeyance is a court order, upon agreement between the prosecution and defendant, for the defendant’s acceptance of guilt or no contest which does not lead to a judgment of conviction so long has he or she complies with specific conditions set forth in the plea in abeyance agreement.

This may be an attractive option for some defendants as it results in either a lower degree of offense or a complete dismissal of the defendant’s case upon successful completion of the terms of the agreement.

Criminal events happen everyday in our society. Though, we hope we never encounter one of these events or have a loved one commit a criminal act, sometimes it does happen. There are certain rights that shop owners have and when it comes to shoplifting these rights can sometimes be muddled and fall into the gray area. The mass media that now exists in our society perpetuates that gray area, but also clarifies actions and events in many cases. Research shows that people in positions of authority are extremely careful in the profession due to the existence of and global use of social media and cell phones. It’s drastically changed the way that news is shared, spun and witnessed according to many law firms in Salt Lake City Utah.

Recently, a video taken of a man being bitten, stripped of clothing and physically thrown about a gas station has gone viral. The video is being used as evidence by the victim, who is now suing the store and its employees. According to the video and reports, the individual was approached about stealing a candy bar, and then assaulted. During the incident, the accused admitted to taking the candy but expressing that he had taken nothing else and had nothing else on him. While this declaration was being made, a nearby patron was filming the incident. In the video, you can see the employees biting, stripping and heavily restraining the individual. According to limited reports, one employee involved in the incident has since been fired, and the outcome of the case remains to be seen.

It’s an unfortunate circumstance and many across the nation have mixed feelings about the incident and where exactly the blame should or will fall.
